Well thanks for the information. I will make sure to relay this information to her. She had said the papers she was served with asked for money. I dont know if this is an indication that this is civil but i hope it is. Her attorney was supposed to go to court for her on Monday. If you know a good attorney please let me know. This is around La Ceiba. I knew i should have not let her go....

She has a certain number of days to have her attorney answer the complaint, and if not answered properly and on time, she automatically looses--right or wrong. Second, you NEVER can touch another person's fence, especially that of a feuding neighbor and especially where there is some land ownership dispute. You need the written permission of the adjoining landowner or a court order to take down a fence--even if that fence absolutely is wrong. If she were accused criminally there might be an "orden de captura" and they will take her passport. Her attorney can tell her immediately if it is a criminal or civil matter. Remember, whether a date is set or not in the papers she received, there is under statute a certain, fairly short time frame for an answer to be filed with the court, and if not filed, that's when they might issue the orden de captura for her, if it is in a criminal court, which it probably is. She better move fast on this. Again, she primarily needs to have proper and immediate legal representation (and there are many, many fine attorneys in the country) and listen to her attorney.

Hello all Please help! My girlfriend was born in Honduras and is a legal resident of USA. She went back to Hondurus last week to put a fence around property that her parents had willed to her many years ago. In the process she ripped down the longstanding efnce of the adjacent land becuase the papers she ahd showed that fence to be on her land. The fence belongs to a sister she is feuding with. The sister served her with papers and a lawsuit for damages and stated the papers SHE had showed the fence to be on the right location. The notice is a legal document involving court but does not list a court date. A lawyer she is dealing with syas that she cant leave the country but I dont believe that as I know the lawyers there are not honest and milk money from clients. Does anyone know if she can board her flight this Weekend and simply go back to Honduras when a court date is selected??? I dont see why not, the papers dont say she cant leave the country.
